Website and retail order terms

Terms for using the catalogue, completing checkout and reviewing a submitted retail order.

Website use

You may use this website for lawful personal-use product research and retail inquiries. Do not interfere with the website, submit false or harmful content, attempt unauthorized access or copy content in a way that infringes applicable rights.

Order submission and acceptance

Checkout records the customer’s requested products, retail quantity and delivery information and provides an order reference. A customer account is optional; customers may use Google, a verified email account or guest checkout. Stripe securely authorizes the displayed order total. Fairwind Commerce confirms product availability and any product-specific conditions before capturing the authorized payment. If an order cannot be accepted, the authorization is released.

Retail-only sales

Orders are accepted only from individual end users and household caregivers buying for personal use. Requests for resale, businesses, health-care facilities or professional use are not accepted.

Product, price and availability

Catalogue details may be manufacturer-listed and subject to confirmation. Product subtotals shown at checkout use the current listed Canadian-dollar retail prices and exclude tax, shipping, installation and other services. We may correct errors and decline or revise an order before written acceptance.

Payment and delivery

Card information is entered directly with Stripe and is not stored by Fairwind. Completing Stripe Checkout authorizes the displayed total but does not automatically capture it. Fairwind captures the authorized amount after confirming product availability. Card authorization periods are limited; if an authorization expires, a new checkout may be required.

Third-party information

Manufacturer photographs and documents may belong to third parties and are provided for retail product information. Fairwind does not control third-party websites and is not responsible for their separate content or privacy practices.

Liability and applicable law

To the extent permitted by law, Fairwind is not liable for indirect or consequential loss arising from website use, delays or unconfirmed catalogue information. Nothing excludes liability or customer rights that cannot legally be excluded. These terms are governed by the laws of Ontario and the applicable laws of Canada.
